Terms of Use
These Terms of Use (“Terms”) govern your use of mobile applications, websites, and related services operated by LIV Studio (“we,” “our,” or “us”), including msqrd and our other apps listed at liv-apps.netlify.app (together, the “Apps”).
By downloading, installing, creating an account, or using an App, you agree to these Terms and to our Privacy Policy. If you download an App from the Apple App Store, you also agree to Apple’s Licensed Application End User License Agreement, which these Terms include as a supplement in section 17. If you do not agree, do not use the Apps.
Features described below apply where the relevant App actually offers them. Not every App includes accounts, AI generation, a public feed, or in-app purchases.
1. Who may use the Apps
The Apps are not intended for children under 13, or under the minimum age required in your country. You must be able to enter into a binding agreement. If you use an App on behalf of an organization, you confirm that you have authority to bind it to these Terms.
2. Sign-in and accounts
Some Apps can be used only after you sign in. Where an App supports accounts, you may create an account with a login and password, or sign in with a third-party provider such as Sign in with Apple or Google, if that option is shown.
- Your account is personal. Do not share your password or let others use your login.
- You are responsible for activity that happens under your account until you sign out, reset access, or delete the account.
- A login, display name, or profile name must not impersonate another person or brand.
- Sign in with Apple or Google is handled by those providers. We receive only what they send us to create or link your account (for example an identifier and, if you allow it, a name).
- If you lose access, recovery depends on the App (for example a password reset, a recovery PIN, or signing in again with the same Apple or Google account). We may not be able to restore an account if you cannot prove control of it.
- We may refuse, suspend, or close an account if these Terms are violated or if we need to protect the service or other users.
3. Account deletion
Where an App has accounts, you can delete your account from the App settings, or by asking us at the email below. When an account is deleted, we remove or irreversibly unlink the account and, as a rule, the generations, photos, and profile data stored with it, including works that were in the public feed.
- Deletion is permanent. You will not be able to restore that account, its private library, or its public posts.
- Deleting an account does not cancel an App Store or Google Play subscription by itself and does not refund tokens, credits, or past charges. Cancel paid subscriptions in your Apple or Google account settings.
- Copies that others already saved, screenshots, or files you shared outside the App are outside our control.
- We may keep limited records if the law requires it (for example purchase or abuse records) for as long as needed.
4. License to use the Apps
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Apps on devices you own or control, solely for their intended purpose. We and our licensors retain all rights in the Apps, templates, designs, software, trademarks, and documentation. You may not copy, reverse engineer, scrape, resell, or circumvent technical limits except where the law does not allow us to prohibit that.
5. Generations and storage
In Apps that create results from a photo or other input (including AI templates), a “generation” is a result stored with your account: the output image and related data such as template, time, and visibility.
- A generation is stored on our servers until you delete that work in the App, or until you delete the account.
- Until then, you can usually open it again from your profile or history in the App.
- By default a generation is private: only you (when signed in) can see it in your library.
- Failed or incomplete generations may still appear in your history until you delete them.
- We may create smaller preview copies to show lists and feeds. Those copies are kept on the same basis as the generation.
- We do not promise storage forever if we shut down a product, if you violate these Terms, or if we must remove content for legal or safety reasons.
6. Public feed
Some Apps have a public feed. A generation is not shown to other users until you choose Publish (or an equivalent control) for that work.
- After you publish, the work can appear in the public feed and on related surfaces in the App (for example popular or profile views that others can open). Other users may view it and, where the App allows, like it.
- You can usually hide or unpublish a work later. It then leaves the public feed, but we may keep it in your private library until you delete the work or the account.
- Publishing is your choice. Do not publish photos or results you do not want others to see.
- Likes and view counts are features of the App, not a promise of promotion or payment.
7. Your content
“Your Content” means material you submit or create through an App: photos, camera or gallery images, profile names, generations, public posts, likes, and similar data.
You keep any rights you already have in Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, adapt, and distribute Your Content as needed to operate the Apps — including generating results, keeping your library until deletion, and showing a work in the public feed after you publish it.
You confirm that:
- you have the rights and permissions needed to use and share Your Content (including photos of people, if required by law);
- Your Content does not infringe others’ rights and does not violate these Terms;
- once you publish, other users of the App may see that work.
We may remove or restrict content that appears unlawful, harmful, or in breach of these Terms. We are not obliged to monitor everything users post, but we may do so to run the service.
8. AI generation and outputs
Some Apps use automated or AI systems to transform photos or produce other results (“Outputs”).
- Outputs are provided as-is. They may be inaccurate, unexpected, similar to other users’ results, or fail to generate.
- Outputs are not professional, medical, legal, or financial advice.
- Subject to the rights of us and our licensors in templates and models, we grant you a license to use Outputs you create in the App for personal, non-commercial use, and for sharing through features we provide (such as a public feed or the system share sheet), unless a specific App says otherwise.
- Credits, tokens, or attempts used for a generation are typically consumed when the request is accepted, including if the result is not what you wanted or generation fails, except where we choose to restore them.
- You remain responsible for how you use Outputs and for not using them to harm others or break the law.
9. Acceptable use
You agree not to:
- upload or generate illegal, pornographic involving minors, hateful, violent, or harassing content;
- infringe copyright, trademarks, or privacy or publicity rights;
- impersonate others, spam, or manipulate likes, rankings, or feeds;
- interfere with the Apps, probe our systems, or bypass paywalls, rate limits, or App Check / integrity protections;
- use the Apps to train competing models or to build a competing service by systematically copying templates, outputs, or user content;
- use the Apps in a way that creates unreasonable load or risks other users’ safety.
10. Purchases, tokens, and subscriptions
Some Apps offer paid features through the Apple App Store or Google Play, including auto-renewable subscriptions (such as Premium), one-time purchases, and consumable credits or tokens.
- Prices, duration, and what you get are shown in the App and in the store listing before you buy.
- Payments are processed by Apple or Google, not by us directly. Their terms and refund rules apply.
- Subscriptions renew automatically until you cancel in your Apple or Google account settings. Manage or cancel at least 24 hours before the period ends to avoid the next charge, as required by the store.
- Consumable credits and tokens have no cash value, are not transferable, and generally are not refunded if unused, expired, or spent on a generation you dislike.
- Purchases are tied to the store account used to buy them. Restoring purchases uses the store’s restore flow.
- We may change prices or offerings going forward. Existing subscription periods already paid are not reduced retroactively except as required by law or the store.
11. Third-party services
The Apps may rely on Apple, Google, Sign in with Apple or Google, Firebase, analytics providers, CDNs such as Bunny.net, payment stores, and similar vendors. Their terms and privacy policies apply to their services. We are not responsible for third-party sites or SDKs beyond our reasonable control.
12. Availability
We do not guarantee that the Apps will be uninterrupted, error-free, or that a particular template, generation, or feature will remain available. We may change, limit, or discontinue features, including for maintenance, legal, or cost reasons.
13. Disclaimer of warranties
To the maximum extent permitted by law, the Apps and Outputs are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow certain disclaimer limits; in those places our disclaimers apply only as far as the law allows.
14. Limitation of liability
To the maximum extent permitted by law, LIV Studio and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Apps. Our total liability for any claim relating to an App is limited to the greater of (a) the amount you paid us for that App in the three months before the claim or (b) USD 10, except where liability cannot be limited (including for fraud or personal injury caused by negligence, where such a rule applies).
15. Termination
You may stop using an App at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we shut down a product. Sections that by nature should survive (including licenses you granted, disclaimers, and liability limits) remain in effect.
16. Apple App Store
If you downloaded an App from the Apple App Store, you and LIV Studio acknowledge the following. In this section, “Licensed Application” means that App.
- Parties. These Terms are concluded between you and LIV Studio only, and not with Apple. LIV Studio, not Apple, is solely responsible for the Licensed Application and its content. These Terms do not set usage rules that conflict with the Apple Media Services Terms and Conditions.
- License on Apple devices. The license for the Licensed Application is a non-transferable license to use it on Apple-branded products that you own or control, and only as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with the purchaser may access it through Family Sharing or volume purchasing where Apple allows that. Except as those Usage Rules permit, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, transfer, redistribute, or sublicense the Licensed Application. If you sell your Apple device, you must remove the Licensed Application from it first.
- Maintenance and support. LIV Studio is solely responsible for providing maintenance and support for the Licensed Application, as described in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the Licensed Application.
- Warranty. LIV Studio is solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed in these Terms. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are LIV Studio’s sole responsibility.
- Product claims. LIV Studio, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of it, including (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property. If any third party claims that the Licensed Application, or your possession and use of it, infringes that third party’s intellectual property rights, LIV Studio, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual-property infringement claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the Licensed Application, for example your wireless-data service agreement.
- Third-party beneficiary. Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
- Liability. These Terms do not limit LIV Studio’s liability to you beyond what applicable law permits.
17. Apple Standard EULA
If you download an App from the Apple App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) applies in addition to these Terms. The Standard EULA is incorporated into these Terms as a supplement. The controlling text is the agreement Apple publishes here:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
Read that page before you use an App from the App Store. In addition to section 16, the Standard EULA sets the App Store license, including its scope and the Usage Rules, consent to use technical data to provide updates, support, and related services, termination if you fail to comply, rules for external services opened from the App, the warranty disclaimer and liability limit in that agreement, U.S. export restrictions, rights for U.S. Government end users, and the governing law of that agreement.
These Terms govern your relationship with LIV Studio, including accounts, content, generations, and purchases. The Standard EULA supplements them for the copy of the App licensed through the App Store. If a provision of these Terms conflicts with the Standard EULA, section 16 and the Standard EULA control the App Store license, and the rest of these Terms control the services LIV Studio provides to you.
18. Changes
We may update these Terms by posting a new version on this page and changing the effective date. Continued use of an App after changes become effective means you accept the updated Terms. If you do not agree, stop using the Apps.
19. Contact
Questions, complaints, or claims about these Terms or an App should be directed to:
